The Demise of the 28-Clause Peace Proposal for Ukraine: Why Peace Negotiations Continue to Falter

Europe felt a moment of respite on Monday, as the diplomatic emergency caused by the presentation of a new 28-article proposal for ending the war appeared – temporarily – to have been defused. A Washington representative spoke of "substantial progress" after diplomatic discussions in Geneva. On Monday night, the Kremlin made its retaliation: another massive barrage of rocket attacks on Kyiv.

The Rhythm of Peace Talks and Military Action

The sequence of conflicting incidents captured the harsh reality of the outgoing year. By day, political struggles are fought: optimistic declarations are released from different nations. Immense energy is expended on containing certain initiatives. By night, Moscow clearly shows the world that, for them, war remains the primary tool for achieving "resolution".

Nocturnal Warfare

As Russia's attack developed into the early hours of Tuesday, the immediate reality of Ukraine's defenselessness was revealed. Ukraine is capable of detecting rocket firings from Russian territory, a capacity enabled by current data. From vantage locations, Ukrainian air force fighter jets that had been scrambled to intercept incoming guided weapons roared overhead – advanced fighter aircraft provided to Ukraine by European allies.

Shortly after, Kyiv's missile defense thundered: several firings fired to intercept a Russian ballistic missile. This was a sophisticated defense system at work, probably provided by allied countries. Every launch creates sudden vibrations, causing tremors. The brief panic quickly becomes sober acceptance: perhaps the hostile projectile won't hit its mark this time, protecting urban areas from ruin and additional electricity failures.

Persistent Threats

Not long after, a large-caliber weapon opened up on a aerial vehicle somewhere nearby, part of a mobile-fire group – almost certainly allied-provided weaponry. Sadly, the shots failed to hit the hostile drone – it pressed on overhead toward its destination.

With pauses, this persisted until dawn. Kyiv greeted the daybreak reports: several casualties, damage and infrastructure problems in multiple buildings as a result of the night's assault. As customarily, everyone still continued their routines – experiencing conflict. But those full day illustrated Ukraine's essential dependence on international aid – a need that neighboring countries are clearly incapable to replace in the immediate future.

Unsuccessful Negotiations

The comprehensive proposal from US administration generated strong feelings, discussion and serious worry – and briefly redirected concern from Ukraine's largest corruption scandal in years. Yet, we have seen this script before, after prior negotiation attempts and international summits.

Every new approach from US leadership unfolds according to the same pattern: a political offensive against Ukraine, which Kyiv, with allied governments, effectively counters. They manage the tension but never actually secure success. This cycle will, certainly, persist.

Political Considerations

It is convenient to criticize certain parties of persistently promoting Kremlin's demands. But that does not seem to be the entire situation. Washington works based on a assumption familiar among seasoned negotiators: you cannot win at the negotiating table what you have been unable to protect through force. The American government assumes that it is unrealistic to force Russia to surrender the areas that it already controls in Ukraine's occupied territories.

The problem is that while recognising this factual reality, US leadership does minimal to deter Moscow, through words or deeds, from thinking that the situation will not evolve additionally in its advantage in the coming year.

Divergent Views

Therefore, Moscow is confident that duration works to their advantage – that Ukraine and its partners are approaching exhaustion. Their reason to agree to terms that does not give them the largest achievable advantage is close to zero. There may be many attempts to stop fighting, but they will continue as long as Russia's leadership remains supremely confident in the conclusion.

On the contrary, Kyiv believes that Ukraine can still hold out, progressively conceding lives and land but averting a complete military breakdown until situations evolve in its advantage.

Present Conditions

Objectively, there are no real preconditions for a armistice. Now, personal considerations are entering the equation: political desires to mediate resolution and obtain worldwide acknowledgment, and Kyiv's twin challenges – on one hand, not to alienate a key ally, and on the other, to rally Ukrainians around the country's interests against any plan Kyiv finds unsuitable, so that their priority does not move to domestic problems. And although their mission will now be much harder after latest incidents, it remains highly unlikely that this will change their overall approach.

These opposing factors are influencing discussions.

Summary and Prospects

It took a just a single week to terminate the 28 points of the most recent proposal. Assertive and inconsistent approach of the matter by US administration, opposition by Ukraine and the other European countries, along with pacifying measures of representatives, and finally, recent disclosures, all served their function.

While new plans based on established approaches are imminent, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are rooted in Kremlin requirements and demonstrate certain reluctance to alter the situation, if they stand together and strengthen their defence capabilities at a significantly accelerated rate. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's capacity to counter nocturnal attacks will, for the foreseeable future, mainly require sustained allied backing.
